NVPCode of conduct Selfemployed

ESE BV adheres to the code of conduct of the Section Selfemployed of the NVP, (the Dutch Society for Human Resources Management and Organisational Development).

Introduction

Within the Dutch Society for Human Resources Management and Organisational Development (NVP) the section Selfemployed was founded in 1999. By a resolution of the section of 6th September 2001 a code of conduct has been established with rules that have to be adhered to by the members (m/f) of the section when practising their trade. They are advised to mention to their customers that they will conform themselves to this code of conduct, which thereby becomes part of the agreement between member and their customer.

1. Objectives

This code of conduct has three objectives in view:

  • to make a number of norms of the section uniform
  • to make these norms known to the customers;
  • to make it possible for customers to file complaints.

2. Written agreement

When accepting an assignment the member sees to it, that rights and obligations of both parties are laid down in writing. This concerns in any case a description of the work to be done together with definitions of fees, expenses, time frame, reporting and facilities made available by the customer. Also the relationship between member and customer will be expressed carefully so it becomes obvious, that the agreement is not a (not intended) labour agreement. The code of conduct is declared applicable and supplied to the customer. On demand the member shows relevant documents with regard to his independent entrepreneurship to the customer.

3. Expertise

The member only accepts assignments for which he is qualified based on knowledge and experience he can present as acceptable. He keeps up with the developments of his trade area Human Resources and Organisation.

4. Carefulness

The member is careful with regard to his services to all who are involved in the execution of the assignment. He refrains from behaviour that can be detrimental to the trust in him and/or other members of the section.

5. Secrecy

The member is bound to secrecy concerning all information that is not available from general sources, and that is known to him from the customer, of which he knows or ought to know that by communicating it to third parties, he can harm his customer in any shape or from.

6. Sidelines

The member can have more than one customer, but he refrains from activities, whether paid or not, which stand in the way or can stand in the way of the quality of the execution of his assignment(s).

7. Involvement of third parties

If the member has agreed with the customer that he can involve third parties in the execution of the assignment, he answers for the confirmation of these third parties to the code of conduct.

If the member has been charged with the execution of the assignment through a third party (e.g. a consultancy bureau or a bureau for interim management), he is also bound towards the actual customer to this code of conduct, with the exception of article 2.

8. General Conditions

If the member uses General Conditions, this code of conduct prevails in case of contrariety, unless explicitly agreed otherwise.

9. NVP Recruitment Code

If recruitment activities are part of the assignment, the member uses the rules of the NVP Recruitment Code.

10. Observance

The board of the Section Selfemployed of the NVP

  • promotes that the members observe this code of conduct;
  • takes care of periodical revision thereof and;
  • appoints an Observance Committee.

A customer who feels that his interests have been harmed by non-observance of this code of conduct by a member, can file his complaint with the Observance Committee.
